Understanding the Australian Government's Response to the Modern Slavery Act Review

Overview

On 2 December 2024, the Australian Government issued its response to the statutory review of the Modern Slavery Act 2018 (Cth): The first three years (“the Review”). The Review, conducted by Professor John McMillan AO, began in August 2022 and was tabled in parliament in May 2023.

Of particular significance, the Government's response:

  • Maintained the reporting threshold of A$100M;
  • Agreed with the recommendation of civil penalties for non-compliance; and
  • Declined the recommendation to amend the Modern Slavery Act to require reporting entities to establish and explain due diligence systems in their modern slavery statements.
